Can I rent my ADU short term in Oakland?

Updated November 2026

No. As of November 2026, the City of Oakland says ADUs cannot be used for stays shorter than 30 days. State law also requires rentals of state-guaranteed ADUs and junior ADUs to be longer than 30 days.

What is allowed?

  • Long-term rentals of more than 30 days.
  • Housing for family members.
  • Using the unit yourself as a home office or guest space.

Do I have to live on site?

Not for an ADU: state law bars owner-occupancy requirements. For a junior ADU that shares a bathroom with the house, a city can require the owner to live there.

What about tenant rules?

Oakland has its own rent and eviction rules. Before renting, check with the city's Rent Adjustment Program about how they apply to your unit.
